TERMS AND CONDITIONS    

​​​​ ARTICLE 1 - DEFINITIONS

In these terms and conditions the following definitions apply:

The entrepreneur: being Annjoy a natural or legal person who or a part of the company of that natural or legal person that is engaged in retail sales as an independent or franchise entrepreneur.

The consumer: a natural person who is not acting in the exercise of a profession or business and who enters into an agreement with Annjoy

Agreement: any agreement regarding sales between the consumer and Annjoy

Distance contract: any agreement regarding sales between the consumer and Annjoy

Goods: all products that are the subject of an agreement.

 

ARTICLE 2 - APPLICABILITY

These general terms and conditions apply to all agreements concluded between Annjoy  and the consumer are closed.

ARTICLE 3 - THE OFFER

1. The goods offered by Annjoy are clearly and truthfully depicted and/or described. This description must be sufficiently detailed to enable a proper assessment of the offer by the consumer.

2. The offer contains such information that it is clear to the consumer what his rights and obligations are if he accepts the offer and in any case consists of the following parts: - an as accurate as possible statement of numbers, sizes, weights or other properties , or indications for the care, which are essential for the offer; - the price and the amount of the delivery costs, if the consumer asks Annjoy to deliver the goods to an indicated address; - the method of payment and – if applicable – a statement that and how payment in installments is possible; - the design/packaging in which the goods are delivered and instructions for use; - any right of return* and the method of use thereof. - the statement that these General Terms and Conditions apply to the agreement;

3. Delivery to order takes place after written or electronic order by the consumer, unless between the consumer and Annjoy  otherwise agreed.

* All items are custom made, so make sure you have chosen the right size, if you are not sure you can always email, if you still want to exchange the shipping costs are for your own account.

ARTICLE 4 - THE AGREEMENT

1. The agreement is concluded by acceptance of the offer by the consumer.  

ARTICLE 5 - THE PRICE AND THE PRICE CHANGES

1. The price stated in the offer includes VAT.

2. If a price change occurs within three months after the conclusion of the agreement but before delivery, this will not affect the agreed price. The consumer is entitled to dissolution of the agreement if the price is increased after three months after the conclusion of the agreement but before delivery.

3. The second paragraph, first sentence, does not apply to price changes arising from the law, such as an increase in VAT.

 

ARTICLE 6 - DELIVERY / DELIVERY TIME

1. Delivery takes place by putting the goods in the possession of the consumer

2. If the agreement concerns the delivery of the sold goods, this will take place within the delivery time agreed in the agreement and at the specified address.

3. If the presumed delivery time is exceeded, Annjoy will be granted a further period to still deliver. This further term is equal to the original expected delivery time with a maximum of one month. If Annjoy  delivers within this term, any price increase within this further term will not be passed on.

4. If this new term or a fixed delivery time is exceeded, the consumer has the right to dissolve the agreement without further notice of default being required.

5. If ordered goods turn out not to be available, Annjoy . will  consult with the consumer about the possible availability of replacement goods. If the consumer does not agree to the delivery of a replacement good, then he has the right, apart from his other legal rights, to dissolve the agreement, without any costs being incurred for him.

 

ARTICLE 7 - CONFORMITY

1. Annjoy  guarantees that the delivered goods comply with the agreement (conformity). Annjoy  furthermore guarantees that the goods have those properties that, taking all circumstances into account, are necessary for normal use, as well as for a special use insofar as this has been agreed.

2. Annjoy  guarantees that the  services provided correspond to the agreement and are performed with good workmanship and using sound material.

ARTICLE 8 - THE RIGHT OF EXCHANGE.

1. The consumer is entitled to exchange goods for at least ten days*.  The commencement date of this term is the day after the sale or after the day of delivery, unless otherwise agreed. Undamaged and unused goods with the original packaging can be exchanged.

3. Goods that have been manufactured, mixed, processed or made to measure at the request of the consumer, or goods that have been ordered at the request of the consumer are excluded from the right of exchange/return. 

*Only in consultation with the seller.

 

ARTICLE 9 - PAYMENT

1. Payment for goods that are in stock is made in advance.

 

ARTICLE 10 - LEGAL WARRANTY

1. Annjoy  guarantees for a period of 6  months the absence of defects that manifest themselves after delivery. The consumer is entitled to free replacement of defective parts* within a reasonable time. In addition, the consumer has the right to recovery.

  2. Annjoy  does not guarantee defects that arise after delivery of the goods as a result of careless care or incompetent use of the delivered goods or that are the result of changes that the consumer or third parties have made to the delivered goods. Nor does Annjoy  liable for any damage caused as a result of these defects.

3. When invoking the warranty, the proof of purchase must be submitted by the consumer.

4. The consumer fully retains his statutory warranty rights, regardless of the provisions in paragraphs 1 and 2 regarding the  Annjoy  issued warranty.

ARTICLE 11 - ADDITIONAL PROVISIONS TO A DISTANCE CONTRACT

1. In the event of a distance agreement (Article 6:230 under m of the Dutch Civil Code), before the agreement is concluded, Annjoy will provide information, among other things: a. the identity and geographical address of Annjoy  where the consumer can go with complaints; b. the place on its website where Annjoy .'s terms and conditions  be visible; c. the main characteristics of the goods; d. the price, including VAT, of the goods; e. any costs of delivery; f. the method of payment, delivery or execution; g. the term for acceptance of the offer;

2. Annjoy  immediately confirms, when the consumer has accepted the offer electronically, receipt of the acceptance of the offer and delivers the product as soon as possible, but no later than 30 days, counting from the day following the day on which the consumer has placed an order. If this term is exceeded, the consumer has the right to dissolve the agreement without further notice of default. The consumer and Annjoy  can agree on a different delivery time.

3.  When the purchased goods are not available, Annjoy  inform the consumer as soon as possible and repay any (deposit) paid as soon as possible, but in any case within 30 days. When the consumer and  Annjoy  have agreed that an item of equal quality and price may be delivered, then the costs of any return are for the account of Annjoy. Annjoy  must inform the consumer of this in a clear and comprehensible manner.

4. Annjoy . provides in good time upon fulfillment and at the latest upon delivery  the following information to the consumer: a. the information stated under a to h in paragraph 1 of this article.

5. the details regarding any warranty.

ARTICLE 12 - LIABILITY

1. Annjoy  is not liable to the consumer for damage that is the result of a shortcoming, which is attributable to the consumer or is at his risk.

ARTICLE 13 - COMPLAINTS

Complaints about the implementation of the agreement must be fully and clearly described, preferably in writing or electronically submitted to Annjoy  in time after the consumer has discovered the defects. Failure to submit the complaint in time may result in the consumer losing his rights in this regard.

ARTICLE 14 - Shipping costs are calculated on the basis of weight, according to PostNL  prices.

Exchange/return costs are for the account of the consumer, as well as resending the exchanged item.

Annjoy  is not responsible for the loss of the mail item during the mail sorting, in that case Annjoy  contact the consumer for a correct solution.
